The study investigates effects of the implementation of a law authorizing educational leave in Germany on individual participation in adult learning and education (ALE). In 2015, the federal state of Baden-Württemberg introduced the so-calledBildungszeitgesetz, legitimating an exemption for eligible employees of up to 5 days per year with continued payment of salary. Explaining participation in ALE is a central subject of educational research at national and international level. Current theoretical assumptions of rational choice and empirical findings of educational and socio-statistical (...) research suggest that within the general population, individuals’ availability of time affects the decision to participate and therefore lastly determines participation in ALE. However, current academia mainly discusses time as either a prerequisite for learning activities or as an observable outcome of participation and not as an explanatory factor. Furthermore, since recent studies remain on a descriptive level regarding influences of time on participation in ALE, no causal effects of the availability of time on participation are estimated. Hence, our study addresses this research gap by investigating effects of educational policy interventions such as theBildungszeitgesetzon participation in ALE. Policy interventions are ideally suited to examine the significance of time resources for participation, as the implementation of theBildungszeitgesetzprovides a specific timeframe for employees to participate in ALE outside of their working time. Drawing on data from the German National Educational Panel Study, we employ a difference-in-differences estimation strategy with propensity score matching and instrumental variable to identify the direct causal effect of the implementation of theBildungszeitgesetzon participation in ALE (N= 709). This combination toward causal inference controls for observed and unobserved baseline differences as well as heterogeneous treatment effects. The results reveal a non-significant but heterogeneous treatment effect of the implementation of theBildungszeitgesetzon individual participation in ALE. Contrary to our theoretical assumptions derived from rational choice approaches, we cannot confirm the hypothesis that the availability of time resources due to the implementation of theBildungszeitgesetzcauses a positive effect on participation in ALE. Furthermore, the results reveal that the implementation causes decreasing participation rates for younger adults, women and significantly for migrants. (shrink)

Aunque en el tiempo que estuvo en esta cátedra, fray Luis se vio obligado a explicar la filosofía moral de Aristóteles, a lo largo de este artículo comprobaremos que el pensamiento moral de fray Luis de León se nutre de otras muchas fuentes provenientes de la filosofía antigua.

Assessment of decision-making capacity (DMC) can be difficult in acquired brain injury (ABI) particularly with the syndrome of organic personality disorder (OPD) (the “frontal lobe syndrome”). Clinical neuroscience may help but there are challenges translating its constructs to the decision-making abilities considered relevant by law and ethics. An in-depth interview study of DMC in OPD was undertaken. Six patients were purposefully sampled and rich interview data were acquired for scrutiny using interpretative phenomenological analysis. Interview data revealed that awareness of deficit (...) and thinking about psychological states can be present. However, the awareness of deficit may not be “online” and effectively integrated into decision-making. Without this online awareness of deficit the ability to appreciate or use and weigh information in the process of deciding some matters appeared absent. We argue that the decision-making abilities discussed are: (1) necessary for DMC, (2) threatened by ABI, and (3) assessable at interview. Some advice for practically incorporating these abilities within assessments of DMC in patients with OPD is outlined. (shrink)

Thanks to Barton Palmer and John McMillan for these thoughtful commentaries. We found much to agree with and it is striking how so many of the issues relating to decision-making capacity assessment find resonances outside of an English jurisdiction. California and New Zealand are clearly grappling with a very similar set of issues and the commentaries speak to the international nature of these discussions.We will pick up on some main points the commentaries raise.As Palmer notes, DMC law is vulnerable to (...) the criticism that it does not attend to the authenticity of a decision. The work of Francisco de Vitoria has always been related to the founding of the Salamanca School and the defense of the rights of the Indians, as well as with the origin of other similar groups as Coimbra, Évora or Mexico that constitute the Iberian School of Peace. But in recent years it has been questioned that Francisco de Vitoria was the only creator of these schools of thought. Some researchers affirm that there were other thinkers before him who should (...) be recognized for this merit. The purpose of this study is to show the originality of Victoria’s doctrines and to see how they were assimilated by the members of the groups that form the Iberian School of Peace. From our point of view, with independence of the recent debates that have emerged around him, Francisco de Vitoria should continue to be considered the creator of the School of Salamanca as well as of the Iberian School of Peace. La recepción que Heidegger tiene del idealismo alemán data de sus primeros años de formación y ejerce una influencia duradera hasta su pensar maduro. Al interior de ella un caso paradigmático es su interpretación del Freiheitschrift de Schelling en el Sommersemester de 1936. En el presente escrito nos ocuparemos de mostrar como su lectura tiene dos consecuencias centrales. La primera, a partir de su análisis del devenir divino eterno de Dios tal como lo plantea Schelling modifica su propia teoría de (...) la temporalidad originaria en un aspecto central: pasa a considerar a la eternidad ya no como una mera sucesión intemporal de ahoras, sino como núcleo central del tiempo. La segunda cónsecuencia radica en que el examen de las implicancias de este devenir divino articulado con una metafísica del mal permiten a Heidegger revisar el lugar del concepto de hombre que venia utilizando en su lectura de Kant hacia 1929. El presente artículo describe un proyecto de innovación educativa de aprendizaje de competencias, realizado en el Curso Propio de Liderazgo de la Universidad San Pablo CEU, transversal a toda su oferta educativa. Se trata de nuevo proyecto basa- do en una docencia híbrida, donde las masterclass más teóricas se han complemen- tado con un aprendizaje basado en retos vinculados a materias de comunicación y sostenibilidad, aplicando la metodología Design Sprint. In line with Allen Newell's challenge to develop complete cognitive architectures, and motivated by a recent proposal for a unifying subsymbolic computational theory of cognition, we introduce the cognitive control architecture SEMLINCS. SEMLINCS models the development of an embodied cognitive agent that learns discrete production rule-like structures from its own, autonomously gathered, continuous sensorimotor experiences. Moreover, the agent uses the developing knowledge to plan and control environmental interactions in a versatile, goal-directed, and self-motivated manner. Thus, in contrast to several well-known (...) symbolic cognitive architectures, SEMLINCS is not provided with production rules and the involved symbols, but it learns them. In this paper, the actual implementation of SEMLINCS causes learning and self-motivated, autonomous behavioral control of the game figure Mario in a clone of the computer game Super Mario Bros. Our evaluations highlight the successful development of behavioral versatility as well as the learning of suitable production rules and the involved symbols from sensorimotor experiences. Moreover, knowledge- and motivation-dependent individualizations of the agents’ behavioral tendencies are shown. Finally, interaction sequences can be planned on the sensorimotor-grounded production rule level. Current limitations directly point toward the need for several further enhancements, which may be integrated into SEMLINCS in the near future. Overall, SEMLINCS may be viewed as an architecture that allows the functional and computational modeling of embodied cognitive development, whereby the current main focus lies on the development of production rules from sensorimotor experiences. Diseases of complex origin have a component of quantitative genetics that contributes to their susceptibility and phenotypic variability. However, after several studies, a major part of the genetic component of complex phenotypes has still not been found, a situation known as “missing heritability.” Although there have been many hypotheses put forward to explain the reasons for the missing heritability, its definitive causes remain unknown. Complex diseases are caused by multiple intermediate phenotypes involved in their pathogenesis and, very often, each one (...) of these intermediate phenotypes also has a component of quantitative inheritance. Here we propose that at least part of the missing heritability can be explained by the genetic component of intermediate phenotypes that is not detectable at the level of the main complex trait. At the same time, the identification of the genetic component of intermediate phenotypes provides an opportunity to identify part of the missing heritability of complex diseases. (shrink)

We draw on the behavioral agency model to explore the ethical consequences of CEO equity incentives. We argue that CEOs are more concerned with funding pension plans when they have more to gain from their stock options yet will increasingly underfund employee pension funds as their current option wealth increases. Our findings reveal that both effects hold when the CEO has greater power (also occupying board chair) over firm decision making. Our study suggests that there is an ethical dimension to (...) equity incentives, given they are intended to align CEO interests with shareholders, yet potentially incentivize CEO behaviors with adverse consequences for employees. Insights from our findings provide boards and regulators with behavioral levers to protect employee well-being in the context of pension funding. (shrink)

Wayne Martin and colleagues argue that decisions about patients’ best interests must sometimes take into account the interests of others Doctors often find themselves in circumstances where they must make decisions on behalf of an incapacitated patient. As a matter of both ethics and law, such decisions must be taken in the best interests of the patient, but uncertainty remains about what is meant by best interests, especially in relation to the interests of others. Should the interests of others enter (...) into a determination of the patient’s best interests? We believe that they should and argue against a recent trend to focus solely on the patient. It only takes a moment’s reflection to appreciate that the interests of one person are often wrapped up with the interests of others. A patient has an interest in recovering from her illness, but so do her family, employer, care providers, etc. Sometimes these various interests can be independently specified, but in other cases they are inextricably intertwined. Suppose that I am a single parent whose overriding interest is to ensure the wellbeing of my children. In that case the proper specification of my best interest is a function of theirs; I simply cannot determine the one without considering the other. This can create an ethical problem in medical decision making. In circumstances where medical staff must make a decision in the best interests of an incapacitated patient, to what extent can or should they take account of the interests of other people whose lives are affected by the outcome? These ethical issues have taken on a concrete legal shape in the UK with the implementation of the Mental Capacity Act 2005, which specifies that, “An act done, or decision made, under this Act for or on behalf of a person who lacks capacity …. Las diversas notas y glosas manuscritas que Heidegger anota al margen de las páginas en la obra de Aristóteles permiten conocer mejor la influencia que este libro ejerció en la filosofía heideggeriana y (...) descubren que «el taller histórico y filológico» que Martin Heidegger instauró a partir del texto aristotélico fue crucial para el desarrollo de algunos conceptos fundamentales de su pensamiento. We examine the unique nature of agency problems within publicly traded family firms by investigating the earnings management decision of dominant family owners relative to non-family. To do so, we draw upon literature demonstrating that family owners are loss averse with respect to the family’s socioemotional wealth, or the affective endowment derived from firm ownership and control. Our theory and findings suggest that potential reputational consequences of earnings management lead family principals to engage in less of this practice relative to (...) non-family firms, and that founder family firms are less likely than non-founder family firms to use earnings management. Moreover, the family-firm effect varies with the firm size, the degree of CEO entrenchment, and the firm’s stock structure. We provide important insights regarding differences between family and non-family principals in the use of unethical accounting practices, thereby extending agency theory and advancing an underdeveloped research area. We report on an interview-based study of decision-making capacity in two classes of patients suffering from depression. Developing a method of second-person hermeneutic phenomenology, we articulate the distinctive combination of temporal agility and temporal inability characteristic of the experience of severely depressed patients. We argue that a cluster of decision-specific temporal abilities is a critical element of decision-making capacity, and we show that loss of these abilities is a risk factor distinguishing severely depressed patients from mildly/moderately depressed patients. Focusing on the constitutional changes undergone since 2005 in Iraq, Sudan, Morocco, Tunisia and Egypt, this article explains how the constitutional limitation clauses affected the respective material constitutional transformations. The explanatory value of the limitation clauses is tested, with possible causalities (as well as non-causal relations) explored through a case study. Generalizing research arguments are offered, theorizing about the material constitutional transformation processes in authoritarian and post-authoritarian scenarios. The research arguments shed light on the limitation clauses’ potential to reveal the (...) policy intent underlying the constituent power, as well as their negative implications for a proper democratic consolidation, their effects in keeping dynamics of political immobilism, and their consequences in terms of favouring instances of authoritarian regression. The use of images in education has received little attention despite the dual role of images in school textbooks, one aimed at the acquisition of knowledge and the other at the transmission of attitudes, values and norms, that constitute a valuable source of historical, educational and communicative research. We will study, through the analysis of content, the characteristics of the catechisms, the legislation of the time related to the publication of school textbooks, the presence of images, types, the didactic function (...) and the transmission of social models and ideology. The research suggests that the images of school catechisms are not simply reflections of a reality that facilitates the learning of the contents taught in schools, but that they also become an effective tool in the transformation of the values and ideological thinking of the social context in which they are produced. El objetivo de este artículo es realizar una propuesta didáctica atractiva y motivadora que favorezca la implicación del alumnado universitario en las asignaturas vinculadas a la Historia económica. A través de una metodología propia de la Historia Oral se pretende establecer un vínculo entre los estudiantes, las técnicas de investigación historiográfica y la evolución histórica de su región en materia económica y social. Researchers working in the field of ecosystem services (ES) have long acknowledged the importance of recognising multiple values in ecosystems and biodiversity. Yet the operationalisation of value pluralism in ES assessments remains largely elusive. The aim of this research is to present a taxonomy of values and valuation methods to widen the evaluative space for ES. First, we present our preanalytic positions in regards to the values and valuation of ES. Second, we review different value definitions that we deem relevant (...) for the discussion of ES valuation. Third, we propose a taxonomy of ES values based on different conceptions of human-nature relationships. Finally, we present a taxonomy of different methods that can be used to recognise plural values in ES. This taxonomy for a plural valuation can help ES scientists and practitioners with their aim of representing people's multiple and context-specific ways of valuing nature. The taxonomy can also serve to pay broader attention to ES values that are overlooked or misrepresented in assessments that restrict their focus to monetary valuations. (shrink)

This study details the methodological process for creating a tool for the identification of COVID-19 potential contagion situations in sports and physical education before, during, and after practice and competition. It is a tool that implies an educational and methodological process with all the agents of the sports system. This tool identifies the large number of interactions occurring through sports action and everything that surrounds it in training, competition, and organization. The aim is to prepare contingency protocols based on an (...) exhaustive analysis, risk detection, and proposal of contingency measures trying to reduce the residual risk to a minimum. In the second part, the results of the implementation of this tool in the sports system of Galicia (Spain) are shown. The technicians have changed their perceptions about the coronavirus transmission in sports. They highlight the problem for returning to sports participation for athletes under 18 years in the pandemic context. (shrink)

Fray Luis, who was always opposed to this view, will try to defend himself on the basis of the work De doctrina christiana of St.Augustine and putting forward that to correctly interpret Scripture is necessary the scholastic Theology, but (...) also other wisdoms such as history or language knowledge. La “Escuela de Salamanca”, como etiqueta histórica, ha sido cuestionada y actualizada en múltiples ocasiones y desde intereses muy diversos. En este artículo se investiga el origen del concepto en la teología alemana del siglo XIX (en autores como Franz Ehrle y Gerhard Schneemann, especialmente) y se presta atención al contexto político y religioso en el que emerge (la denominada _Kulturkampf _alemana), con el propósito de comprender mejor las notas definitorias que se le otorgaron.

The 3-valued paraconsistent logic Ciore was developed by Carnielli, Marcos and de Amo under the name LFI2, in the study of inconsistent databases from the point of view of logics of formal inconsistency (LFIs). They also considered a first-order version of Ciore called LFI2*. The logic Ciore enjoys extreme features concerning propagation and retropropagation of the consistency operator: a formula is consistent if and only if some of its subformulas is consistent. In addition, Ciore is algebraizable in the sense of (...) Blok and Pigozzi. On the other hand, the logic LFI2* satisfies a somewhat counter-intuitive property: the universal and the existential quantifier are inter-definable by means of the paraconsistent negation, as it happens in classical first-order logic with respect to the classical negation. This feature seems to be unnatural, given that both quantifiers have the classical meaning in LFI2*, and that this logic does not satisfy the De Morgan laws with respect to its paraconsistent negation. The first goal of the present article is to introduce a first-order version of Ciore (which we call QCiore) preserving the spirit of Ciore, that is, without introducing unexpected relationships between the quantifiers. The second goal of the article is to adapt to QCiore the partial structures semantics for the first-order paraconsistent logic LPT1 introduced by Coniglio and Silvestrini, which generalizes the semantic notion of quasi-truth considered by Mikeberg, da Costa and Chuaqui. Finally, some important results of classical Model Theory are obtained for this logic, such as Robinson’s joint consistency theorem, amalgamation and interpolation. Although we focus on QCiore, this framework can be adapted to other 3-valued first-order LFIs. (shrink)

Según la doctrina del “discurso del odio”, todo mensaje calificable como tal supondrá por definición un abuso del derecho fundamental a la libertad de expresión. Esta doctrina, elaborada en distintas etapas por el TEDH a lo largo de las últimas décadas, ha sido seguida por la jurisprudencia española como pauta interpretativa de los llamados “delitos apologéticos”. En atención a esta linea, la ratio legis de este grupo de delitos consistiría, simplemente, en la prohibición del discurso del odio. La vaguedad de (...) esta idea ha llevado a un sector doctrinal a abandonar el paradigma del bien jurídico, para defender como alternativa la distinción entre daño y ofensa. En el presente trabajo se expondrán y valorarán críticamente los presupuestos y efectos de la “doctrina del odio” y se relativizará la eficacia práctica del binomio “daño-ofensa”, para llegar a una conclusión común: ambas concepciones son tautológicas. This article develops the relationship between Hans-Georg Gadamer and Spanish philosophers at the end of the 20th century after the completion of a research stay in the Deutsche Literatur Archiv in Marbach. New materials and unpublished correspondence recently found in the Deutsche Literatur Archiv in Marbach reveal common interests and intellectual links between Hans-Georg Gadamer and several Spanish philosophers: Jose Ortega y Gasset, Julián Marías, Laín Entralgo, Xavier Zubiri or Emilio Lledó. The letters, that Gadamer wrote and received, show that (...) the evident dialogical character of Gadamer’s hermeneutic was always one of his most representative characteristics. These unpublished notes are of particular interest in the understanding of the history of philosophy in Spain and the hermeneutical development. (shrink)

Este artículo realiza un análisis crítico de las respuestas que se han estructurado a nivel jurídico y político para hacer frente a las migraciones climáticas. Resalta la necesidad de incorporar el enfoque étnico-racial en el abordaje de este fenómeno debido a su impacto diferencial sobre los derechos de las personas afrodescendientes e indígenas, en especial en lo relativo al territorio y la propiedad colectiva. Examina, además, las causas estructurales que le subyacen y utiliza ese estudio como base para fijar parámetros (...) que puedan ser tenidos en cuenta en la construcción de futuras políticas internacionales. This study draws upon the behavioral agency model and the concept of socioemotional wealth to investigate how family firms’ employee pension underfunding decisions differ from those of non-family firms. We explore how these differences are influenced by financial distress, generational stage, and whether the firm is eponymous. We test our hypotheses using data from 452 US firms over an eleven-year period. Our results suggest that family firms are less likely to underfund pensions, but this effect is attenuated in later generational (...) ownership stages and in non-eponymous firms. (shrink)

Belnap–Dunn’s relevance logic, \(\textsf{BD}\), was designed seeking a suitable logical device for dealing with multiple information sources which sometimes may provide inconsistent and/or incomplete pieces of information. \(\textsf{BD}\) is a four-valued logic which is both paraconsistent and paracomplete. On the other hand, De and Omori, while investigating what classical negation amounts to in a paracomplete and paraconsistent four-valued setting, proposed the expansion \(\textsf{BD2}\) of the four valued Belnap–Dunn logic by a classical negation. In this paper, we introduce a four-valued expansion (...) of BD called \({\textsf{BD}^\copyright }\), obtained by adding an unary connective \({\copyright }\,\ \) which is a consistency operator (in the sense of the Logics of Formal Inconsistency, _LFI_s). In addition, this operator is the unique one with the following features: it extends to \(\textsf{BD}\) the consistency operator of LFI1, a well-known three-valued _LFI_, still satisfying axiom _ciw_ (which states that any sentence is either consistent or contradictory), and allowing to define an undeterminedness operator (in the sense of Logic of Formal Undeterminedness, _LFU_s). Moreover, \({\textsf{BD}^\copyright }\) is maximal w.r.t. LFI1, and it is proved to be equivalent to BD2, up to signature. After presenting a natural Hilbert-style characterization of \({\textsf{BD}^\copyright }\) obtained by means of twist-structures semantics, we propose a first-order version of \({\textsf{BD}^\copyright }\) called \({\textsf{QBD}^\copyright }\), with semantics based on an appropriate notion of four-valued Tarskian-like structures called \(\textbf{4}\) -structures. We show that in \({\textsf{QBD}^\copyright }\), the existential and universal quantifiers are interdefinable in terms of the paracomplete and paraconsistent negation, and not by means of the classical negation. Finally, a Hilbert-style calculus for \({\textsf{QBD}^\copyright }\) is presented, proving the corresponding soundness and completeness theorems. (shrink)

This article describes the political practices of a part of the Italian women’s movement that, as of the 1980s, gave way to the sexual difference thought. Through a political analysis of their own experience, which removed any humanist identity assumptions, the women’s movement generated new practices and discourses. With these, women were able to exert self-criticism, and simultaneously to produce new subjectivities articulated around the sexual difference concept. The difference thought helped highlight the limits of institutional policy, renewing the premises (...) of political analysis and redefining the borders of what was deemed to be ‘political’. Intended to foster dialogue with other feminist proposals, the article underlines the situated nature of this political experience and focuses on the method, the political praxis and the process rather than the outcome, the conclusions or the theory. The objective of the study was to translate and validate the COVID Stress Scales into Spanish in Peru. Around 1,424 people, selected through a non-probabilistic sampling, participated in the study. Factor analysis confirmed an initial six-dimensional factorial structure of the CSS-36. Reliability by internal consistency was good for the dimensions of fear of danger, socioeconomic consequences, xenophobia, fear of contamination, traumatic stress, and compulsive control. In addition, the factorial structure of scale has been shown be strictly invariant for both males (...) and females. The Spanish version of the CSS-36 has evidence of validity, reliability, and invariance to measure COVID-19 stress in a Peruvian sample. (shrink)
